Mindy McCready is not having a good week. Her lawyer wants to make sure Vivid Entertainment has a worse one.

Hence the latest missive fired in the escalating battle over her unauthorized (for now) sex tape, Mindy McCready, Baseball Mistress. A day after unleashing a written warning, attorney Adam Dread has gone one step further, sending a cease and desist letter to Vivid's head perv, Steven Hirsch.

"We'd like to do this Southern-style," McCready's Nashville-based lawyer told E! News. "We're gentlemen down here. I wish Steven would just give me a call."

Too bad Hirsch seems hell-bent on settling this Valley-style.

In any case, Dread isn't just waiting idly by the phone. He's threatening legal action against the porn purveyors unless they either produce proof that McCready approved the tape's release (she vows she didn't) or stop all promotion of the XXX footage and hand over all copies to Dread. For professional purposes only, of course.

"It's so hard for Mindy," Dread said. "I've known her a very long time. She's had such a good year. She's sober, she looks great, she has a new album. And then this happens."

As it stands, this is still scheduled to happen on adult sites everywhere April 19.
