UPDATE: LAPD spokesman Richard French tells E! News an investigation into the Gibson case is "ongoing."

"Early this morning, about 1:20 a.m., a man came into the Hollywood Division police station to report that Mel Gibson had pushed him when he attempted to take a photo inside the Playhouse nightclub," says French.

"The victim stated that he was not injured and an investigation is ongoing into the incident. However, initial investigation by detectives has shown witnesses who had been interviewed did dispute the account of what happened." French says he could not confirm the photographer's allegation that the Oscar winner had torn his shirt.

Investigators have no plans yet to interview the Lethal Weapon star, says French, but may do so at some point.

After a late-night excursion to a new L.A. nightclub, Mel Gibson ended up on the receiving end of a criminal complaint.

He and pregnant fiancée Oksana Grigorieva were attending Wednesday night's grand opening of Playhouse when a shutterbug apparently got too up close and personal for Mr. Mad Max's liking, and Gibson allegedly ripped the guy's shirt.

According to a spokeswoman for the LAPD's Hollywood Division, the unidentified photog filed a police report early this morning accusing the 53-year-old Oscar winner of battery.

Meanwhile, a source close to Gibson says he and Grigorieva were out celebrating a big milestone.

“He was 100 percent sober last night,” says the insider. “He was celebrating his three years of sobriety” since his infamous 2006 DUI meltdown.

News of the altercation was first reported by Hollyscoop.com, which had a photo of the alleged victim.

No comment yet from Team Mel. No charges have been filed, and a police source has questioned the validity of the complaint.
