David Letterman Plotter Loses Appeal

Some stupid human tricks have their consequences.

So ruled the Montana Supreme Court in turning down the appeal of the man once accused of plotting to kidnap David Letterman's infant son for ransom.

Kelly Frank, 47, copped a plea in 2005 that saw the kidnap-related charges ultimately dismissed, but nabbed him a 10-year prison sentence for obstruction of justice, felony theft and illegal poaching.

The handyman escaped from a prison work detail in July 2007 and, after being recaptured about a week later, was slapped with another 10-year jail term.

Frank appealed the escape conviction but Wednesday's decision by the state's highest court upheld the sentence. He will still be eligible for parole in May 2011.
