Malawi Supreme Court will hear pop star's case on May 4; Madonna not required at hearing

Madonna is looking to get back on the horse, literally and figuratively.

While the Material Mama is still recovering from minor injuries after being thrown from her steed Saturday, her lawyers are busy saddling up for round two of her attempt to adopt 3-year-old Chifundo "Mercy" James.

On May 4, a three-judge panel from Malawi's Supreme Court of Appeal will convene to hear Madonna's opposition to a lower court's decision earlier this month rejecting her bid to take custody of the girl.

Madonna is not required to be present during the hearing, which could last up to two weeks and which will be held in closed chambers due to the fact that a minor is involved.

On April 3, a judge ruled against Madonna, saying that despite her good intentions the pop star did not meet the basic residency requirements for prospective adoptive families and that bending the rules could set a dangerous legal precedent for foreigners and, more specifically, child traffickers.

The requirement was waived back in 2006, when Madonna and then-hubby Guy Ritchie adopted their first child from the country, son David. His adoption was finalized last year.

Meanwhile, Madonna was spotted back out in Amagansett Sunday after spending the night recuperating at pal Gwyneth Paltrow's Hamptons pad.

After making sure that none of the photographers snapping away yesterday was the same one she blamed for her accident, Madonna told them that she was feeling "better."

On Saturday, her publicist alleged that flashes from an unwelcome paparazzo spooked Madonna's horse into dumping the singer. But freelance photographer Thomas Hinton has refuted the accusations.

Hinton told the New York Daily News that he was shooting pictures of Madonna Saturday but left after failing to get a good vantage point. He returned 40 minutes later, by which time, he claims, the accident had already transpired.

"I arrived more than 10 minutes after she fell, and I was shooting from the street," he said. "I don't know what [her rep] is talking about."
