Van Der Beek's Soggy Victory
Dawson's creek runneth over...and into his living room.
A North Carolina jury has ruled in favor of James Van Der Beek in his legal battle with a real-estate agent who sold him a water-logged home four years ago.
The New Hanover County Superior Court panel agreed Thursday that realtor Gwen Page misrepresented the condition of the waterfront pad the onetime Dawson's Creek star purchased in Wilmington, North Carolina, while taping the WB series.
Van Der Beek didn't just win, he won big. The actor was awarded $123,000 in damages--$20,000 more than he was looking for. In return, all the jurors got a handshake from the former teen heartthrob as they left the courtroom.
The 27-year-old thesp, who testified earlier in the week and was in court for the verdict, embraced his wife, Heather, following the jury's ruling.
"I'm just pleased with the verdict and I thank the jury for all their time and hard work," he told reporters. "Even under the circumstances, it's really terrific to be back. It just reminds me how much I really miss the area."
Van Der Beek, who layed out $826,000 for the home in February 2000, had asked for $103,000, intended to cover an $83,000 repair bill for water damage and $20,000 for the commission fee paid to Page and her codefendant, Intracoastal Realty.
Despite the testimony of several local real-estate agents on her behalf, the jury found Page had committed fraud and made negligent representations to Van Der Beek regarding the sale of the home.
She reportedly left the courtroom crying, and her lawyer declined to issue a statement.
Van Der Beek sold the home last December after taping wrapped on six seasons of Dawson's Creek. During that time, he parlayed his TV success into several feature films, including Varsity Blues, Scary Movie and Texas Rangers, but has largely been away from the spotlight since 2002's The Rules of Attraction. He recently completed filming on the indie drama Standing Still, costarring Mena Suvari, Colin Hanks and Ethan Embry, but no release date has been set.
