Spector Jury Deadlocked

Phil Spector may be hanging tough, but it's possible that his jury is just hanging.

The jury foreman in the music producer's murder trial told Los Angeles Superior Court Judge Larry Paul Fidler on Tuesday that after seven days of deliberations, the panel is split 7-5, though he did not indicate which way the majority was leaning.

"I believe it comes down to individual jurors," the foreman, a civil engineer identified as Juror 10, told the judge. "At this time we don't believe anything will change the positions of the jurors."

Fidler is now reconsidering giving the 12 jurors the option of deliberating on the lesser charge of manslaughter rather than second-degree murder.

Spector's defense immediately requested a mistrial, but Fidler denied the motion after three jurors indicated that further instructions may help them out of their impasse.

Fidler sent the jury home for the day, adding that he would give the panel additional instructions Wednesday morning.

"Just set the case aside for the rest of the day," Fidler said.

When the jury resumes deliberations, Fidler said he would hear arguments from prosecution and defense attorneys on whether to give jurors the option of the involuntary manslaughter charge. If he decides in favor of the reduced count, Fidler said attorneys would have a chance to make their case to the jury on Thursday.

Spector is accused of killing actress Lana Clarkson in the foyer of his Alhambra mansion on Feb. 3, 2003, just hours after meeting her at the West Hollywood House of Blues, where she worked as a hostess.

The defense argued that Clarkson, depressed over the declining state of her career and finances, accidentally shot herself.
