Sizemore Warrants Scrutiny
Tom Sizemore couldn't get arrested Tuesday.
The embattled actor skipped a court hearing, faced further accusations of parole violations, but managed to avoid jail, even as a Los Angeles judge issued a warrant.
The order by Los Angeles Superior Court Judge T.K. Herman was put on hold until July 22, when another jurist, Paula Adele, can sort out the mess. If Sizemore isn't before the bench on that day--and his lawyers said he was unavailable Tuesday on account of his checking into rehab--the warrant could be activated.
Technically, rehab is where Sizemore is supposed to be following his March sentencing for felony drug possession. Except, these days, the 43-year-old never seems to be quite where he's supposed to be. L.A. County Deputy District Attorney Sean Carney told the Los Angeles Times that Sizemore's rehab stint could be considered a probation violation because the facility wasn't, as required, approved by authorities.
Alleged parole violations are mounting as fast as film credits on Sizemore's résumé. The tough-guy character actor once best known for playing one of the good guys in Saving Private Ryan also stands accused of not submitting to drug tests every three days, as required, missing rehab counseling sessions, as required, and deploying a Whizzinator in order to fake a drug test, as generally frowned upon.
The alleged Whizzinator incident occurred May 25, spurring Sizemore's most recent run of court dates. It is not to be confused with the alleged Whizzinator incident from February in which Sizemore first was accused of packing a prosthetic penis for the purpose of supplying a bogus urine sample. Then as now, Sizemore denied Whizzinator wrongdoing.
When not battling drug-related allegations, the actor is appealing a misdemeanor domestic violence conviction involving former girlfriend Heidi Fleiss. If he loses that appeal, a 17-month jail term, for yet another spate of parole violations, could kick in, per a separate sentencing from March.
In addition to Private Ryan, Sizemore's A-list credits include Black Hawk Down, Pearl Harbor and two short-lived CBS series, Robbery Homicide Division and dr. vegas. According to IMDb.com, he has nine films either in the can or in the production for this year and next--so, maybe Sizemore can get arrested, after all.
Certainly, prosecutors seem to be counting on as much.
