Rush Guitarist Cops Plea
Rush guitarist Alex Lifeson is in no hurry to go to jail.
According to a posting on the band's Website, Lifeson cut a plea deal with Naples, Florida, prosecutors Apr. 21 that guarantees the 51-year-old will not do any time for his part in a hotel brawl in the early morning hours of Jan. 1, 2004.
The case had been scheduled to go to trial Monday.
Thanks to their plea, Lifeson, whose real name is Alex Zivojinovich, and his 34-year-old son, Justin, each will be put on one-year probation. In addition, the two must pay court costs and restitution.
In exchange, prosecutors agreed to reduce the charges from felonies to misdemeanors. Lifeson was initially charged with two counts of battery assault on a law enforcement official, punishable by up to 10 years in prison.
The agreement "closes a difficult and painful period in the lives of my family, my friends and myself," Lifeson said in a statement.
Perhaps it was the prospect of a long prison stint that made Lifeson change his tune. Lifeson had long maintained that he did nothing wrong at the hotel party and that security guards were overzealous in their "rush" to stop the rocker from having a good time. In March, his lawyer said the rocker was ready to go to court.
The "Tom Sawyer" guitarist was arrested after a New Year's Eve party got out of hand. The fracas started when security guards at the Naples Ritz-Carlton tried to force Justin off the stage after the younger Zivojinovich climbed up with the house band. Father apparently came to son's defense. Authorities said Lifeson pushed a sheriff's deputy down the stairs of the hotel and spat blood at another. Lifeson suffered a broken nose in the melee.
A part-time resident of Naples, Lifeson was initially booked on six charges, four of which were felonies that could have netted the fretman 30 years in prison if found guilty. However, after an investigation, the state attorney's office reduced the charges to two counts of assault on a law enforcement official.
With his criminal case behind him, Lifeson can focus on his music. He is set to headline a charity concert in Toronto on June 7.
