Rodriguez Faces More Jail for Probation Slacking
Michelle Rodriguez's fast and furious ways aren't sitting too well with the powers that be.
The Los Angeles City Attorney's Office has filed a motion to revoke the actress' probation, claiming she not only failed to live up to the terms, but she also falsified information to make it appear as though she had. As a result, Rodriguez, whose credits include Lost, The Fast and the Furious , S.W.A.T. and Resident Evil, could face serious jail time. (View the motion.)
There was no immediate comment from Rodriguez's reps.
Prosecutors say that the actress violated the terms of her court-ordered alcohol-monitoring program and never completed the requisite 30 hours' community service.
However, Rodriguez didn't just fail to complete her community service—prosecutors say she submitted paperwork to the court, signed by a purported supervisor, alleging that she had served a full day of do-gooding on Sept. 25, 2006. She later confirmed, however, that she spent the whole of the 25th in New York City, far from any supposed community servicing locale.
The flagrant failure to abide by the terms of her probation has ticked off the city attorney. The office has suggested to the court that Rodriguez be imprisoned for up to 537 days, pay $2,010 in fines and be slapped with 38 more months of probation.
Rodriguez previously served just four hours and 20 minutes of a two-month probation violation sentence in May 2006.
"When one repeatedly fails to abide by the terms and conditions of probation, probation has failed as rehabilitative device and the People of this state [i.e., prosecutors] have a great interest in being able to imprison that person," states the motion, which was filed Thursday.
Sould Rodriguez 'fess up to her probation-dodging ways, prosecutors hint they might be more lenient.
"If Ms. Rodriguez fails to accept responsibility for her actions and fails to admit that she is in violation of her probations, then the People move this court to...impose sentences on each count to the maximum extent allowable," the motion continues.
"If, however, Ms. Rodriguez accepts responsibility for her actions and admits that she is in violation of her probations, then the People move this court to impose...substantial jail time on both counts with only seven months of probation remaining before expiration."
In that case, Rodriguez would also be compelled to perform a "verifiable" 30-day stint of community service.
Since 2004, Rodriguez has been charged with no less than eight counts by the city attorney, including two counts each of driving with a suspended license and driving without a valid license and one count each of driving under the influence, hit and run, driving with a blood-alcohol level above 0.08 percent and failing to exchange information at an accident scene.
Rodriguez's probation has also been revoked twice before: First, in May 2006, after she failed to complete her community service and again in August 2007. Both times the actress copped to violating the terms of her sentence.
As a result of her most recent violation, for both falsifying her community service documents and her alcohol-monitoring program, a probation-violation hearing was scheduled to take place later Friday.
