Rock Blocks Sex Tape

He may be the self-professed Pimp of the Nation, but Kid Rock wants to keep his own sexploits private.

The trailer park rap-rocker scored a legal victory Tuesday when a federal judge temporarily blocked an online porn peddler from hawking a steamy sex video featuring Rock and former Creed crooner Scott Stapp receiving oral sex in a 45-minute lovefest with four female fans.

Attorneys for Rock sued David Joseph, president of California-based Red Light District, seeking a permanent injunction prohibiting the company from ever releasing the tape. As part of the lawsuit, the attorneys requested--and obtained--an order to have a 40-second sneak-peek removed from the Red Light-run sites KidRockSexTape.com and ScottStappSexTape.com.

In his ruling, District Judge John Feikens declared that Red Light had violated the Cocky performer's privacy and trademark rights and ordered the preview taken down pending a full hearing set for Friday.

While it didn't contain any explicit sex acts, the preview was intended to hype the full-blown release of a lengthier video at an unspecified date later this year, featuring both rock stars hooking up with various groupies (but not with each other) on a tour bus when Rock and Creed were on the road together back in 1999.

Since the footage had been shot by several people, Joseph, whose company was responsible for releasing Paris Hilton's infamous One Night in Paris, claimed that he didn't need the musicians' cooperation to release it.

But Rock, whose real name is Robert Ritchie, felt differently.

"We don't deny the authenticity of the tape," the "Cowboy" singer's attorney, William Horton, told the Detroit Free Press Tuesday. "But they're using this without his permission to drive the sales of their other products."

Ray Tamaddon, a lawyer for Red Light, said the porn purveyor voluntarily pulled the clip last Friday after Stapp's legal eagles sent the company a cease-and-desist letter . However, he defended Red Light's claims to distribute the tape.

"We had looked into the legal issues and felt confident that what we were doing was well within our rights," Tamaddon told the Free Press, claiming that since both men are public figures means their behavior is ripe for the selling.

Rock's camp was unavailable for comment. Although the performer was granted a temporary injunction, in recent years the courts have traditionally ruled against celebrities who claim sex tapes unlawfully exploited their names and public images.

The American Badass could follow his ex's lead and endorse the video's sale in exchange for a cut of the profits, as Pamela Anderson and former hubby Tommy Lee did with their sex tape, and Hilton with hers. Or he could take Red Light to court to block its release as was the case with Colin Farrell.
