Pierce Cleared of Paparazzo Punch

When it comes to Pierce Brosnan, it seems the evidence was not enough.

Los Angeles prosecutors announced Tuesday that no criminal charges would be filed against the former James Bond for a dustup with a paparazzo in Malibu last month.

"After a complete review of the investigation done by the Los Angeles County Sheriff's Department...there is insufficient evidence to prove this case to a jury beyond a reasonable doubt," Deputy District Attorney James Garrison said in a statement.

Brosnan could have faced a possible misdemeanor battery charge for allegedly popping photographer Robert Rosen outside a Mexican restaurant.

The incident took place Oct. 26 about 6:15 p.m. as Rosen confronted the 54-year-old actor and his young son at the entrance of the Malibu eatery Casa Escobar.

The shutterbug, identified by TMZ as an employee of celebrity photo agency Ability Films, claims he approached Brosnan and complimented him on his run as 007 only to be cursed out and punched in the ribs by the star.

Eyewitnesses claimed Rosen retaliated with a kick to Brosnan's midsection, then fled the scene.

Rosen filed a report with the Sheriff's Department, which investigated and presented its findings to the L.A. County District Attorney's Office, which ultimately decided whether or not to bring criminal charges.

Brosnan's reps declined to comment on the incident. Rosen was also unavailable.

The actor is reprising his role as a dashing art thief in The Topkapi Affair, a sequel to 1999's hit remake The Thomas Crown Affair. He next appears on the big screen in the feature-film version of Broadway's ABBA-powered musical Mamma Mia! opposite Meryl Streep, due out in July 2008.
