Patric Sues Over Texas Hold 'Em

Forget Texas. Maybe the bumper sticker should read "Don't mess with Jason Patric."

The actor has filed a lawsuit against an Austin cop, claiming his civil rights were violated and he was falsely imprisoned last March while visiting the Lone Star state to promote The Alamo.

The Texas hold 'em began when Patric, 38, was standing with a group of friends outside a local nightclub at about 3 a.m. That's when he was approached by a police officer, taken into custody and charged with public intoxication and resisting arrest.

Prosecutors ended up dismissing the misdemeanor charges a month later, citing lack of evidence.

According to his suit filed Friday in U.S. District Court, Patric claims the lawman used excessive force and manhandled the actor. The New York native says he "was doing nothing illegal, was sober and was clearly not a danger to himself or to others."

Earlier that evening, Patric had been in San Antonio for the premiere of The Alamo, in which he portrayed Texas hero Jim Bowie alongside Dennis Quaid's Sam Houston and Billy Bob Thornton's Davy Crockett.

Unfortunately, playing a legend did little to assuage Austin's finest, who, per the police report, believed the erstwhile Lost Boys star was a rabble-rouser who drank too much and was acting aggressive.

As police moved to put the cuffs on him, Patric allegedly shoved an officer and insisted to take a sobriety test. Police claimed that because his eyes were supposedly dilated and he smelled of alcohol no test was needed, and Patric was hauled off to the pokey, where he cooled his heels until he was released on a $1,000 bond the next morning.

His suit seeks unspecified damages.

An Austin Police Department spokesperson did not return phone calls seeking comment. Patric's rep, Michelle Bega, issued a statement when the charges were tossed last May saying the actor felt "vindicated" by prosecutors' decision and that he was considering legal action over his treatment.

"I am really looking forward to going back to Austin and taking care of business," Patric said at the time.

Aside from The Alamo, which misfired at the box office, Patric recently starred in the Broadway revival of A Cat On a Hot Tin Roof opposite Ashley Judd. Other film credits include Narc, Speed 2: Cruise Control, Sleepers, Rush and Geronimo: An American Legend.
