O'Neal Won't Be Charged for Discharge

Ryan O'Neal is in the clear for a family feud. At least as far as one key party is concerned.

Prosecutors will not file charges against the 66-year-old actor for a bruising brawl at his Malibu home with eldest son Griffin O'Neal, the Los Angeles District Attorney's Office said Friday.

"Today we found insufficient evidence to file a case against Ryan O'Neal," D.A.'s office spokeswoman Sandi Gibbons said.

The decision was reached, Gibbons said, after a review of the case, including new rounds of interviews with witnesses.

Ryan O'Neal was arrested Feb. 3 on suspicion of assault with a deadly weapon and negligent discharge of a firearm. He was booked, sat down for a mugshot, and bailed out on $50,000.

From the get-go, Ryan O'Neal's legal team portrayed 42-year-old Griffin O'Neal as the aggressor, while Griffin O'Neal's side painted the elder O'Neal as the bad guy. Only Ryan O'Neal was arrested.

Per Ryan O'Neal attorney Mark Werksman, the Love Story star acted in self-defense, with the expended bullet described as a warning shot meant to deter the son charging at his father with a fireplace poker.

Per Griffin O'Neal attorney Gloria Allred, the older man sent the younger man's pregnant girlfriend, 22-year-old Joanna Berry, to the hospital with scrapes, cuts and a bone fracture. Ryan O'Neal countered that Griffin O'Neal was responsible for Berry's injuries.

On Friday, Allred, who also represents Berry, told a local Los Angeles wire service that, in the wake of the D.A.'s decision, the couple "will now explore all of their legal options."

Werksman, meanwhile, told the Associated Press that prosecutors' call not to file charges was "a tremendous relief" to Ryan O'Neal.

The respective combatants have never publicly gone into detail as to what exactly led to the heated events, although Werksman said it was spurred by a dispute over Griffin O'Neal's alleged mistreatment of Redmond O'Neal, Ryan O'Neal's 22-year-old son with Farrah Fawcett.

Tatum O'Neal, who was not present for the family fracas, jumped into the fray when she told Entertainment Tonight shortly after the incident that she believed her brother Griffin.

"No matter what my dad is saying in the press, Griffin was not trying to start a fight with him; he was attempting to protect Redmond," Tatum O'Neal said. "I'm sure when the police sort out the facts, the truth will be revealed."

The good news from the D.A.'s office for Ryan O'Neal, late of an episode of Fox's Bones, comes on the heels of bad news for Fawcett. Last week, the ex-Charlie's Angels star announced her anal cancer had returned. Ryan O'Neal and Fawcett were a couple during most of the 1980s and 1990s. He has remained close to her during her health battle.
