New Judgment Day for Diaz Photog
The trial for one of Cameron Diaz's least-favored photographers could develop early next year.
John Rutter, the lensman behind the racy Diaz video making the Web rounds since the summer, has been ordered to stand trial beginning Feb. 23 over topless photos taken of the star during her pre-Charlie's Angels halo-wearing days.
The case has been headed to trial before only to be delayed along the way. The latest calendar entry was made Friday at a hearing in Los Angeles.
Diaz may, or may not, be present in court when Rutter finally faces jurors. The actress is on the witness list.
Rutter snapped revealing footage of the teen-aged Diaz in 1992, when revealing shots were what one did before one shot to stardom in films such as The Mask. Diaz's camp maintains the shots were never meant for publication. (The video from the steamy session, nevertheless, has been available for sale since July. Its title: She's No Angel.)
Fast-forward a decade, and Diaz, now Hollywood's top-paid actress, tells authorities Rutter demanded $3.3 million to keep the pics under wraps. (He says it was a business offer, not a threat. An extortion charge against Rutter didn't take and was dropped.)
The case is complicated by a model release form that Rutter says Diaz signed back in the day, giving him the right to sell the pictures. Diaz and prosecutors say the signature is a fake.
Rutter is charged with forgery, perjury and attempted grand theft. He has pleaded innocent to all charges, and has filed a $10 million breach-of-contract lawsuit against Diaz.
Diaz's relationship with all shutterbugs, not just Rutter, reportedly has reached new heights, or depths, with London's Sun saying she's hired a staffer to shoot (in a photographic sense) paparazzi who shoot her (in a similar photographic sense).
The reputed move comes as Diaz and boyfriend Justin Timberlake are fending off a lawsuit from a pair of photogs who claim the stars pounced on them as they tried to take the couple's picture outside a Hollywood hotel last month. Diaz and Timberlake insist they were the ones pounced upon.
A police investigation into the incident is pending.
