Michael Weatherly's crash from last year totaled his car. It may soon empty his pockets.

The NCIS star is being targeted by the other driver in the crash, who claims he was severely injured in the October 2010 accident.

The other driver, Ivan Romeo Mendez, filed his suit in Los Angeles County Superior Court, is seeking more than $80,000 in medical expenses (and potentially much more in other damages) for injuries sustained when his BMW was struck by Weatherly's Mercedes.

Mendez says he was hospitalized for neck and back pain following the mishap and needed a procedure called rhizotomy to sever spinal cord nerves. He claims to still be suffering ill-effects of the crash.

In the personal injury complaint, Mendez alleges he has endured wage loss, general damage, property damage, loss of earning capacity and is seeking hospital and medical damages.

There was no immediate comment from Weatherly's rep.
