Montgomery Driven to Woe

John Michael Montgomery is a little bit country, and a lot of trouble.

The "I Love the Way You Love Me" singer pleaded not guilty Thursday to a litany of charges stemming from a drunken driving arrest in Lexington, Kentucky, earlier in the day.

Lexington Police spokesman Major Barry Cecil said Montgomery was arrested and charged with driving under the influence, possession of a controlled drug, having a prescription drug not in its proper container, two counts of carrying a concealed deadly weapon, disregarding a traffic control device and improper turning.

"John Michael is not yet able to comment in detail regarding the impaired driver allegations," the singer's attorneys said in a statement. "We are awaiting completion of a final report to be issued by the arresting officer.

"He's never been in a situation like this before and he hates it."

According to the police report, the 41-year-old singer had two loaded handguns in his car at the time of his arrest, one under the driver's seat and one under the passenger's seat. The report also listed the controlled drug as Valium, which was in a bottle marked as the painkiller Endocet. The prescription was made out to one of Montgomery's friends.

The singer was arrested at 2:30 a.m. Thursday after reportedly running a red light and weaving across lanes just a few miles from the Austin City Saloon, where Montgomery admitted to spending part of his night. Police say he smelled strongly of alcohol. He allegedly failed a field sobriety test and refused a blood test before being arrested.

He spent several hours in jail before being released from custody. His driver's license was automatically suspended.

Jon Woodall, one of Montgomery's lawyers, entered a not guilty plea on the singer's behalf. The singer was attending a previously scheduled doctor's appointment at the time and was excused from the court proceedings.

Woodall claimed that most of the charges stemmed from a misunderstanding and that Montgomery had a prescription for the painkiller and permits for the guns, just not on him at the time of his arrest.

"It's not unusual for people to leave things at home," another Montgomery attorney, Brent Caldwell, said. "I sometimes walk out of the house without my driver's license."

As for the medication, Caldwell said the painkillers were prescribed following Montgomery's recent hip surgery. According to the lawyers, the operation could also be to blame for the failed sobriety test, as Montgomery has difficulty standing on one leg due to his slow recovery.

"In order to treat pain associated with that surgery and his recovery John Michael's physicians have prescribed certain pain medications," their statement said. "The controlled substance charges relate specifically to this prescription medication."

The Kentucky native rose to fame in the early 90s, when he landed 15 number one hits on the singles charts, including "I Swear," and "Sold (The Grundy County Auction Incident)."

Montgomery hits the road Mar. 4, kicking off a tour in Laughlin, Nevada.
