Miss Ross Won't Miss Jail

Diana Ross is home free.

And home is where the diva will stay, if she so chooses, after a judge in Arizona on Monday ruled she doesn't have to go back to jail.

"Justice has prevailed," Ross attorney Stephen Paul Bernard told the Tucson Citizen. "This is what justice is all about."

Last month, Tucson City Magistrate T. Jay Cranshaw said the Supreme one had to come back to Arizona to redo a two-day jail sentence for drunken driving.

Ross served her time, or so she'd thought, in February in Greenwich, Connecticut, where she has a home.

But after reviewing reports from Greenwich police, Cranshaw declared Ross hadn't served enough time, failing to log 24 consecutive hours and 48 total hours in the slammer.

Ross' camp argued (we paraphrase for the legalese impaired): Nu-uh.

Her lawyers told the court the Motown legend reported to jail on Feb. 9 with the intent of staying put until her debt to society was paid in full. But because of jailhouse staffing issues, Ross was asked to go home twice. It took her until Feb. 12 to complete the so-called two-day sentence.

Prosecutors last week agreed with Ross' lawyers that the singer couldn't be held accountable for the Greenwich police's actions or time-card calculations.

With Cranshaw's ruling Monday, Ross is now square with Arizona, where she was busted for DUI in December 2002. She pleaded no-contest to charges on Feb. 9, the same day her jailus interruptus term began in Connecticut. She remains on one year's unsupervised probation.

The 60-year-old "Can't Hurry Love" star recently completed a concert swing through Europe.
