Lindsay's Parents ThisClose to Divorce
At least one Lohan family legal drama is showing signs of being settled.
After years of bickering both in and out of the courtroom, the long pending divorce of Lindsay Lohan's parents, Dina and Michael, may be resolved as soon as next Friday, when the estranged couple's next hearing is scheduled to take place.
"My understanding is that we are extremely close to crafting an agreement?" New York State Supreme Court Justice Robert A. Ross asked the elder Lohans' respective attorneys, before the start of an hourlong closed-door conference.
"We're moving toward a resolution, which is a good thing," Dina told reporters outside the courthouse in the Long Island town of Mineola.
Michael's attorney, Joe DiMascio Jr., seconded the sentiment, adding that only some "minor points" remained to be resolved and that he was confident a resolution would come before their next court date on Aug. 17.
Neither side disclosed which minor points were holding up the proceedings or what went on during the hearing. At the couple's last meeting in family court on July 27—matrimonial and custody aspects are, per state law, being hashed out separately in both Nassau County Family Court and New York State Supreme Court—Judge Stacy Bennett ordered Michael to get a job and start forking over $500 a week in child support for the duo's two minor children.
The Lohans have long been at odds over the custody of their youngest kids, 13-year-old Aliana and 11-year-old Dakota. Lindsay, 21, and Michael, 19, are no longer minors and therefore not part of the ongoing discussions.
The elder Michael says he has not seen any of his children since getting sprung from prison in March after serving 25 months for attempted assault, drunken driving and driving without a license.
At last month's Family Court hearing, Bennett also ordered the patriarch to undergo an evaluation by a family therapist to help determine visitation privileges.
However, the matter appeared to be cleared up in the state supreme court today, as Ross reportedly granted Michael visitation privileges with Aliana and Dakota, provided those visits take place under the supervision of a Teen Challenge pastor and two lawyers. Michael has been living at the Christian-based drug and rehabilitation center Teen Challenge since March.
While Lindsay is not a part of the divorce proceedings, she was, as expected, a topic of conversation—at least outside the courtroom. Neither parent commented as to her exact whereabouts, but her father seemed to confirm she was back in rehab for the third time this year. (Entertainment Tonight and The Insider both reported she was seeking treatment at a facility in Sundance, Utah.)
"She's in a good place," Michael told Extra. "I think she's come to a point where she realizes she's got to turn this around. She's an amazing kid with an amazing gift."
He also sounded off on an interview the Mean Girls star's former bodyguard of three years, Tony Almeida (yes, he shares a name with a character on 24), gave to In Touch Weekly. Almeida claimed Michael abused Dina, stalked and took money from Lindsay, had hysterical fights with both Dina and Lindsay on a regular basis and openly took drugs in front of the children, all of which Almeida suggested led to Lindsay's downward spiral.
Michael sent this statement to OK! magazine:
It is sad to say but Tony Almeida is a desperate and disgruntled employee who is destitute and will do anything for money. In doing this he has violated a confidentiality agreement which proves lack of integrity...Yet again, this is an instance of someone living off Lindsay and our family for their own personal gain.
To address his 'stalking' claim, I never entered Lindsay's property in L.A. Tony knows that, but now is dejected and in dire straits he has gotten very 'creative'...Records will prove, I never took one red cent from Lindsay directly or indirectly, nor did I ever touch Lindsay or any of my children.
As I have admitted, I slapped Dina once in 1989 and I have truly regretted it ever since. Tony never saw me doing cocaine because I was not doing it at that time.
Lindsay was never afraid of me. If anything, she turned to me when she had problems.
As for Lindsay, she's due on Aug. 24 in courtrooms in both Santa Monica and Beverly Hills for her dual DUI cases.
