Before she ever gets to play Elizabeth Taylor, Lindsay Lohan will have to recreate a role she knows all too well: Defendant.

The starlet has been sued by a paparazzo who claims that, two years ago, he was taking photos of her and then got hit by the car she was riding in as it sped away from a Hollywood club.

Sigh...

Lohan and the driver, Paola Demara, were named as defendants, along with management company Tri Star Sports and Entertainment.

Shutterbug Grigor Balyan didn't provide many details in the suit, other than his allegation that the defendants "so negligently, carelessly, and recklessly operated, maintained, repaired, owned, and controlled their automobile so as to cause an accident which resulted in personal injuries and property damage to Plaintiff."

But Balyan told E! News that, while Lohan's assistant was driving, the starlet was laughing.

"I was hit. I really wanted them to stop," he said, alleging that they dinged him and then drove off. "It doesn't matter if [Lohan] is the driver or not driver she should not hit any kind of person in the alley.

Meanwhile, the lawsuit, which was filed today, comes on the heels of a TMZ report that Lohan owes almost $100,000 to the IRS.

"We're not commenting on her personal financial situation," her rep, Steve Honig, told E! News.

As for Balyan's suit, Honig said he found it "peculiar" that they had not seen the complaint, and yet "it is all over the tabloids."
