The former My Name is Earl star will avoid the slammer and serve three years on summary probation after striking a deal with prosecutors that saw her plead no contest today to a misdemeanor DUI count of driving with a blood-alcohol .08 percent or higher, stemming from last January's bust in Santa Monica.
In exchange, prosecutors agreed to drop another count of driving under the influence.
Pressly's attorney, Richard Hutton, entered the plea on her behalf at the Los Angeles Airport Courthouse.
Santa Monica Deputy City Attorney Melanie Skehar tells E! News that in light of the different blood alcohol test results done by the police and by Pressly's defense team, the actress was also ordered to complete a 6 month alcohol program instead of a 9 month program and pay $390 in fees plus penalties.
Skehar says the split results came about after the defense had it retested with their own criminalist and "it came back a .20 and we had a .22. In light of that, we agreed to a lower alcohol program."
Pressly got into this mess when she was popped for suspicion of driving under the influence on Jan. 5 after cops pulled her over for a routine traffic violation. Officers gave the Emmy winner a field sobriety test, which she promptly flubbed. She then submitted to a Breathalyzer and blew a .22, more than three times the state's legal limit.
A rep for the thesp was unavailable for comment, but Pressly could have faced six months in jail if she had been convicted.
So long as she stays out of trouble, she can now get back to ironing out the details of her pending divorce from entertainment lawyer Simran Singh. The couple split last December nine days before her arrest.
