Halle Settles House Suit
In her just-released suspense thriller Gothika, Halle Berry wakes up imprisoned in a haunted insane asylum. Off-screen, fortunately, she no longer has to worry about her living situation.
The Oscar winner, who last summer bought a Beverly Hills mansion with now-estranged husband Eric Benét, has settled a $2 million legal battle with the previous homeowners, her lawyer has announced.
Berry filed a fraud and breach-of-contract lawsuit on June 10 against civilians Jonathan and Alison Roth, alleging they kept her in the dark about $1 million in needed maintenance on the property before Berry purchased the plot to build a new mansion.
Her attorney, Martin Singer, told Los Angeles' City News Service that a tentative deal was struck last month with the couple. No terms of the settlement were disclosed, but Berry, who announced her separation from Benét in October, will hold onto the property.
What was supposed to be a dream home for the 35-year-old actress and her hubby wound up playing out like The Money Pit and The Amityville Horror.
Berry launched her legal salvo two days after the Roths filed a preemptive lawsuit of their own in which they alleged the actress knew about the property's condition and agreed to buy the residence "as-is."
According to Berry's suit, the Roths told her that the construction plans for the Benedict Canyon Drive residence would not pose a problem because there was stable bedrock five feet below ground level.
However, Berry alleges that she only found out about "numerous geological defects" after the $2 million sale was final.
Berry rejected a cash settlement and gave notice that she intended to sue over the matter. A day later, on June 10, the Roths' responded with their legal action. Their attorney, Dale Kinsella, asserted that Berry knew what she was buying beforehand, and if she didn't, she still had 30 days to inspect the property before plunking down the cash.
Singer did not return calls seeking comment on Monday; Kinsella was out of the country and unavailable to discuss the settlement.
Now that Berry's got her property situation figured out, the big question is whether she'll be around enough to develop her would-be estate, given her hectic work schedule.
Berry is wrapping up production in Toronto on Catwoman opposite Benjamin Bratt. After the holidays, the two are slated to reteam and shoot The Setup for director Sydney Lumet.
After that, Berry's scheduled to star in Nappily Ever After from indie helmer Patricia Cardoso (Real Women Have Curves) and Lee Tamohori's action-thriller The Guide.
