Gold Pleads Innocent to DUI

Those growing pains were nothing compared to this.

Tracey Gold, facing potential prison time, is now counting on her lawyer to prove she is no drunk driver.

The former Growing Pains actress pleaded not guilty Tuesday to three felony charges relating to a September DUI arrest in California.

Gold did not speak during the hearing in Ventura County Superior Court; her attorney, Blair Berk, entered the plea on Gold's behalf.

The mother of three was strictly business Tuesday as she appeared for her arraignment. The actress did not address reporters about details of the case, but Berk spoke briefly, saying Gold is "acting very responsibly and taking all this very seriously."

Gold, 35, was piloting the family SUV on Sept. 3, when it flipped on a highway in Moorpark, California, seriously hurting her husband and two of her children.

According to the California Highway Patrol, Gold's husband, Roby Marshall, 39, sustained a neck injury from the accident. In addition, Gold's 7-year-old son, Sage, suffered a broken collarbone, and her 5-year-old son, Bailey, some cuts. The fourth passenger in the SUV, Gold and Marshall's 4-month-old son, Aidan, was unhurt. Gold also escaped uninjured.

Following a brief investigation, the Ventura County's District Attorney's Office filed three felony counts against Gold: driving under the influence with a blood-alcohol level exceeding the state's 0.08 limit; causing injury while driving under the influence; and child endangerment.

Although the maximum sentence if Gold were convicted on all charges would be five years in a state pen, the actress would not likely face a lengthy stint behind bars.

Given that this is the first time Gold has faced DUI allegations, "the judge [would] take that into consideration," deputy district attorney Kim Gibbons said in September. First-time offenders usually get probation, a suspended license and court-ordered alcohol-awareness programs.

Gold remains free on $50,000 bail.

At the time of Gold's arrest, Berk said, "Tracey is a wonderful mother and incredibly respected in her community. Hopefully the truth of what really occurred will be more important to people than speculation or headlines."

Berk has yet to offer her version of the "truth of what really occurred," but, barring a plea deal, the Gold camp will get to make its case in court in the coming months.

Shortly before the accident, the actress returned to her role of Carol Seaver to shoot ABC's reunion movie special Growing Pains 2: Return of the Seavers. The two-hour telecast aired Saturday to mediocre ratings, finishing 59th in the weekly Nielsens, averaging 6.9 million viewers.
