Feds to Snipes: Stop Griping
Federal prosecutors are trying to trump Wesley Snipes' race card play.
Snipes' legal team filed a motion earlier this month asserting he can't get a fair trial on tax-evasion charges in Ocala, Florida, because of rampant racism in the area. The lawyers asked a judge to have the trial moved to New York or Orlando—or alternately to have the charges against the actor dismissed altogether.
But prosecutors fired back Monday, saying Snipes's claims were "scurrilous and baseless accusations."
Stating in its filing that there was "no basis in reality for these claims," the U.S. Attorney's office rebuffed Snipes' allegation that the Ocala area was a "hotbed" for Ku Klux Klan activity.
As for a study submitted by the actor's attorney that found the potential jury pool in Ocala to have a "greater level of racial bias and prejudice toward Snipes," prosecutors called it self-serving and irrelevant.
The Ocala locale was ostensibly chosen for the trial because the actor's codefendant, Eddie Ray Kahn, operated his Guiding Light of God Ministries, which prosecutors claim provided tax evasion information, from neighboring Lake County.
Snipes stands accused of fraudulently claiming close to $12 million in refunds in 1996 and 1997 for income taxes already paid. He is also charged with failing to file tax returns from 1999 to 2004.
As of now, his trial is due to commence in Ocala in January.
