"Extremely Frightened" Halle Berry Sends Serial Trespasser Packing

Halle Berry, Nahla Aubry Flynetpictures.com

Halle Berry won't have to borrow her X-Men alter ego Storm's superpowers to keep this guy away. Just the courts.

A Los Angeles judge has granted her request for a restraining order against Richard A. Franco, which will prohibit her alleged peeper from coming anywhere near the star and her family for the next three years.

Superior Court Judge Carol Boas Goodson ordered Franco, who currently remains jailed after his arrest earlier this month outside Berry's home, to maintain a distance of at least 100 yards from the Oscar winner and her 3-year-old daughter, Nahla (assuming he gets out, of course).

Franco was nabbed on July 10 as he tried to break into Berry's Hollywood Hills abode, his third attempt in three days.

The actress was home at the time the stalking began and actually spotted the 27-year-old intruder after he scaled a privacy wall and peeked in through her kitchen door. She called 911, but Franco fled the scene after a staff member of her residence confronted him and before police arrived.

The unwanted houseguest subsequently returned to the mansion on two more occasions and it was this time, on July 10, that Halle's private security team held him and handed him over to LAPD.

Franco faces one count of felony stalking as well as a first-degree residential burglary charge stemming from the incidents. A day after he was taken into custody, he also had a temporary restraining order issued against him.

Berry's attorney, Blair Berk, declined to comment.
