Diaz's Alleged Blackmailer Arrested

Cameron Diaz's breasts have landed a man in jail.

Photographer John Rutter was being held Wednesday in Los Angeles in lieu of $250,000 bail, accused of trying to extort $3.3 million from the Charlie's Angels star over some unheavenly topless snapshots, authorities said.

Rutter was arrested Tuesday--his 41st birthday--at his apartment in Venice, California.

Prosecutors charged the shutterbug Wednesday with attempted extortion, attempted grand theft, perjury and two counts of forgery, the Los Angeles County District Attorney's Office said. If convicted, he faces up to six years in prison.

Rutter is scheduled to be arraigned on August 28.

The arrest comes a month after Diaz went to court seeking an injunction preventing Rutter from peddling the photos to publishers, including Hustler magazine.

At the time, Rutter was already under investigation for possible criminal wrongdoing. He told the New York Daily News his apartment was raided by officials from the D.A.'s office on June 30.

As far as Rutter was concerned, the matter was a big misunderstanding. He wasn't trying to coerce cash out of the Gangs of New York star, he said, he was trying to make a business deal. The quarry: Photos taken of Diaz back in 1992, when she was young (19), presumably hungry and not yet famous. (Her movie debut in The Mask was still two years away.)

"At no time were there ever threats or ultimatums," Rutter said in the Daily News. "It was lawyers talking with lawyers."

The five-count indictment against Rutter contains few specifics outside of some dates and the basics of the case.

Prosecutors allege Rutter forged a signed model release form for Diaz in August 2002. Nearly a year later, on June 23, they claim, he sought a multimillion-dollar payoff from the actress.

Per a recent court ruling, Rutter's revealing Diaz pics are being stored in a safety deposit box, far away from Enquirer-ing minds.
