Daddy Lohan Pleads Innocent
The legal woes continue to mount for Lindsay Lohan's dad, Michael Lohan.
The Teenage Drama Queen's troubled paternal unit pleaded not guilty Tuesday in Hempstead, New York, to an upgraded felony charge stemming from an alleged booze-fueled, near-fatal car wreck on Long Island in February.
Lohan, 44, was initially slapped with a misdemeanor count of driving while intoxicated and charged with operating a moving vehicle with a suspended license when his Volvo slammed into a utility pole in the early hours of Feb. 19. He managed to escape unscathed before the vehicle burst into flames.
Nassau County prosecutors requested Judge Claire Weinberg up the latter count to aggravated unlicensed operation of a motor vehicle--a felony. The D.A. said the more serious charge was also warranted because Lohan's blood-alcohol level of 0.14, nearly two times the legal limit of 0.08, and he wasn't supposed to be driving in the first place. Last year, Lindsay's daddy dearest was arrested for driving under the influence and had his license suspended.
The upgraded felony means the elder Lohan could now face up to four years in prison if convicted.
The Hempstead District Attorney's Office also says the misdemeanor DWI charge will still stand.
To make matters worse for Michael Lohan, his February smash-up could derail a plea bargain he struck to avoid jail for assaulting his brother-in-law last summer. If the deal is overturned, Lohan could face additional jail time.
Lohan is currently being held without bail. His next court appearance is scheduled for Apr. 26.
His attorney, Rory Calhoun, told reporters after the hearing that his client was aware of his predicament and was doing his best to "straighten out his life," including signing up for an alcohol abuse program at the Nassau County jail.
Lohan previously completed a court-ordered stint in rehab last December.
The Freaky Friday star's made-for-the-tabloids pop has a long history of bad behavior, including a four-year sentence for stock fraud when Lindsay was a little girl.
But he began spiraling out of control in December 2003, when he was arrested for punching a Manhattan sanitation worker who was allegedly blocking his car; Lohan was sentenced to anger-management courses.
Last June, Michael was taken into custody after whacking his brother-in-law with a shoe at a family gathering. That same month, he was nabbed again for allegedly walking out on a $3,384 hotel bill, an arrest he blamed on a bad credit card, not bad behavior.
Lohan was arrested twice in November for violating a restraining order obtained by his estranged wife, Dina. He was sentenced to one month in alcohol rehab. Upon his release in December, Dina slapped him with divorce papers. Michael responded by filing court papers saying he deserves millions of dollars of Lindsay's earnings.
Lindsay, meanwhile, has repeatedly snubbed her father as her career continues to blossom.
The 18-year-old's debut album, Speak, was recently certified platinum. And Lohan is getting ready to shoot several film projects, including two romantic comedies Just My Luck and Fashionista. She'll then segue into Robert Altman's adaptation of Garrison Keillor's A Prairie Home Companion, followed by roles in two more comedies, an untitled project set in the fashion world and Gossip Girl.
She next appears on the big screen in Disney's Herbie: Fully Loaded, an update of Herbie the Love Bug, which hits theaters June 24.
