D.A.: Sizemore Screwed Up

The Whizzinator could prove to be Tom Sizemore's downfall.

The Saving Private Ryan star, who claimed a few weeks ago to have cleaned himself up, is once again coming under fire from prosecutors, who accuse him of faking his most recent drug tests and violating the terms of his probation.

During a hearing on Wednesday, Los Angeles Deputy District Attorney Sean Carney told a judge that the 43-year-old Sizemore not only failed to meet with his probation officer, but he also missed several drug rehab counseling sessions and did not properly notify authorities of his new address.

Further, drug counselors David Aronek and Isidro Ruiz testified that the actor tried to fake a drug test for a second time on May 25 with the aid of the Whizzinator. That's the infamous prosthetic penis, which contains a clean supply of urine, that Sizemore was caught using to try to pass a February test.

Aronek testified that when Sizemore came back two days later to submit another urinalysis,he appeared to exhibit symptoms of "speed psychosis"--i.e., manic behavior, rambling speech and excess sweating associated with amphetamines. After a half-hour, the counselor said Sizemore copped to being under the influence of crystal meth. He subsequently failed to show up at the treatment center for a May 31 drug test.

As has become his M.O., Sizemore held a press conference outside the court after the hearing to dismiss the allegations.

"I have been clean and sober and they are pandering to the city attorney," he said.

Sizemore's attorney, Gary Meastas, could not be reached for comment.

The actor, known for his tough-guy roles in the films Black Hawk Down and Pearl Harbor, pleaded guilty in October to felony possession of methamphetamine and was sentenced to a drug-treatment program. He made headlines again in February after flunking seven drug tests, including one using the Whizzinator.

On Mar. 24, Los Angeles Superior Court Judge Paula Adele Mabrey ordered the Michigan native to check into a rehab facility by mid-April under the terms of Proposition 36, a California law aimed at rehabilitating serial drug users instead of locking them up.

That same day, another judge, Antonio Baretto Jr., ruled that Sizemore could remain free--as long as he stayed out of trouble--while he appealed his 2003 conviction for hitting former Hollywood madam and ex-girlfriend Heidi Fleiss.

The probation-violation hearing is scheduled to continue on Friday with Sizemore scheduled to take the stand. If the accusations bear out, Sizemore could face up to three years in prison.
