D.A. Seeks Bail in Courtney Case
As Courtney's world turns, episode 758...
The Love bug was MIA from a Los Angeles court hearing Thursday, with her lawyer saying that the trouble-prone rocker remains hospitalized in a New York-area facility.
With Love a no-show, and still wanted on a warrant in a separate case, prosecutors asked Los Angeles Superior Court Judge Elden S. Fox to post $40,000 bail or else cool her heels in jail until trial time in her felony drug-possession case.
The judge didn't immediately rule on the request, preferring instead to wait until a July 23 hearing. In the meantime, Love remains free on her own recognizance
Love's criminal lawyer, Michael Rosenstein, said that the singer, who was hospitalized last Friday, her 40th birthday, for "an emergency gynecological condition" has since "been stabilized."
"She's receiving treatment and she is doing well," he said, adding that Love "will 100 percent be back voluntarily before the jurisdiction to face any and all charges against her. She'll be back as soon as she's released from her care from her physician."
Love is reportedly being treated at a private facility--described by another Love lawyer, Robert Ring, as an "institution"--after being discharged from New York's Bellevue Hospital on Monday. E! Online's Ted Casablanca says Love is in a Connecticut hospital. Ring has said Love has been appointed a legal custodian.
Hours before Love was hospitalized on Friday, she failed to turn up for arraignment in a felony assault case in Los Angeles. Rosenstein told Superior Court Commissioner Dennis Mulcahy that Love was "confused" about whether she had to appear for that hearing and was staying in New York, but Mulcahy didn't buy the excuse and immediately issued a warrant for her arrest. He also bumped up her bail to $150,000.
On Thursday, Deputy District Attorney Gina Satriano cited that warrant as the reason to make Love post bail in her pending drug case, in which she's accused of possessing prescription painkillers sans prescription. She has pleaded not guilty to the charges.
Rosenstein also said Love will be absent from a docket date tomorrow in Los Angeles on yet another charge. Love has pleaded guilty to a misdemeanor account of being under the influence of cocaine during a meltdown outside an ex-boyfriend's house last October and is due to be sentenced Friday.
Rosenstein says he will appear on Love's behalf at the hearing, where she is expected to be ordered into drug rehab. However, there is a chance the judge could push back the hearing until Love is able to show up in person.
"Hopefully," said the lawyer, "there will be no glitches tomorrow whatsoever, and the case will finally be resolved tomorrow."
Better knock on wood, Mikey.
