Cos Crew Denies Groping, Seeks Gag

The Cos is neither a doper nor a groper.

So say lawyers for Bill Cosby who filed a motion this week refuting accusations America's former favorite dad drugged and sexually assaulted her at his suburban Philadelphia home in January 2004.

About the only thing the entertainer's legal camp did cop to was that Cosby did give accuser Andrea Constand one and a half tablets of Benadryl, an over-the-counter allergy medication, after she told him she was stressed out and had a hard time sleeping.

The 31-year-old Constand, who met Cosby while working in the athletic department of his alma mater, Temple University, filed a civil suit against the erstwhile Cliff Huxtable in March, alleging he sexually molested her after giving her some pills that knocked her out.

The litigation came after prosecutors declined to press criminal charges against Cosby, citing "insufficient, credible and admissible evidence." Authorities also pointed to the yearlong delay between the alleged incident and Constand coming forward as damaging her credibility.

Meanwhile, a federal judge heard arguments Wednesday on Cosby's petition for a gag order on the case. Cosby's reps want to keep Constand's lawyers from taking potshots at him in the press and are also seeking to put a lid on evidence that arises during the discovery phase, including potential depositions from at least 10 other women who, per Constand's lawsuit, will testify that the comedian drugged and/or molested them over the past three decades.

"We are entitled to a level playing field here," Cosby attorney Patrick O'Connor told the judge. "Discovery materials are not matters of public record."

Constand's lawyers are fighting the gag order, arguing such an order could taint the jury pool if only good things are said in public about the 67-year-old entertainment icon.

"The problem with this case is that our client has nobody to speak publicly for her but us," Constand attorney Dolores Troiani told the judge. "He is truly Goliath, and she is truly David."

Per her complaint, Constand joined Cosby and other friends for dinner at a Philly restaurant in January 2004. After the meal, Cosby invited her back to his home to offer her advice about her future. While there, she told him about her sleeping problems and he allegedly offered her three blue pills he described as "herbal medicine."

According to court documents, the drug rendered her "barely conscious" but conscious enough to recall that Cosby "touched her breasts and vaginal area, rubbed his penis against her hand and digitally penetrated her."

In his only public statement about the sordid affair, Cosby gave an interview to the National Enquirer in which he apologized if his actions were misconstrued by his accuser, but he suggested he was the target of a shakedown.

"I am not going to give in to people who try to exploit me because of my celebrity status," he told the tabloid. "Sometimes you try to help people and it backfires on you, and then they try to take advantage of you."
