Busboy Shows Lindsay Some Proof
Apparently, Lindsay Lohan's legal team got what it was asking for.
Lawyers for the 21-year-old actress were scheduled to ask a judge at a hearing next month to force busboy Raymundo Ortega to submit proof of his allegations that Lohan had been drinking before their traffic collision in October 2005.
However, Lohan's attorneys filed court documents Tuesday requesting that the January hearing be canceled, stating that Ortega had provided them with documentation of his claims—with which they continue to disagree. (View the court papers.)
Ortega, who is seeking $200,000 in damages, alleges Lohan crashed her Mercedes-Benz into his van while trying to flee paparazzi after a boozy lunch at the Ivy.
Lohan filed a $75,000 countersuit in October, denying that she had been drinking and contending that the California Highway Patrol determined that Ortega was at fault in the crash for making an illegal U-turn in front of her car.
Her lawyers have also pointed out that the CHP found no evidence that alcohol was a factor in the collision.
Ortega's lawyers have said all along that they have witnesses to back up the busboy's version of events.
Last week, TMZ.com published what it said was a copy of Lohan's bar tab from lunch the day of the crash, which showed that her party of five ordered four Ivy Gimlets—a vodka cocktail—over the course of the meal.
Of course, it could be difficult, if not impossible, to prove that Lohan, who was 19 at the time, was one of the recipients of the drinks, especially two years after the fact.
The actress was slated to give a deposition in the case on Dec. 3, but there was no word if she had completed it. Last month, she lost a motion to bar cameras from the session, despite her lawyer's argument that the testimony could fall into the wrong hands.
The case is scheduled to go to trial Apr. 7.
Last month, Lohan logged all of 84 minutes in a Los Angeles lockup, stemming from a plea deal in her double DUI arrests earlier this year.
She has also recently been spotted performing her court-ordered community service at an American Red Cross facility in the L.A. area.
