Blake DAs Want Details Tossed

Prosecutors on the Robert Blake murder trial seem to live by the old adage that you don't speak ill of the dead.

Particularly if there's a lot of colorful material to work with.

Deputy Los Angeles District Attorneys Patrick R. Dixon and Shellie M. Samuels filed a series of motions Monday in the hopes of barring Blake's defense team from highlighting the darker side of wife Bonny Lee Bakley's past when the case goes to trial.

After Bakley was shot to death in May 2001, Blake's legal team quickly released details of her somewhat sordid background, which involved wheeling and dealings of both the crooked and naked variety, as a possible motive for the killing.

On Tuesday, Dixon and Samuels stated that Bakley "might be considered by some to be what is commonly referred to as a 'grifter' or 'con artist.'"

Additionally, given that Bakley sold nude photos of herself through the mail as a source of income, the prosecution argued in advance against "the gratuitous use" of introducing such materials into evidence.

"While the People do not intend to sanitize Ms. Bakley to present her in any false light, the People will object to any attempts to sensationalize Ms. Bakley's career and to portray her as someone who deserved the fate she ultimately suffered," the prosecutors wrote in one of the five motions they filed.

Van Nuys Superior Court Judge Darlene Schempp is expected to consider the prosecution's request at a February 2 hearing.

The prosecution also wants the judge to consider allowing a taped telephone conversation between Bakley and Blake to be played in court. Bakley reportedly recorded the exchange without Blake's knowledge.

On the tape, the couple discuss Bakley's pregnancy by Blake. He is heard urging her to consider an abortion, while she tearfully tells him she wants to be together with him.

"This statement, among others on the tape, is highly relevant evidence of defendant Blake's anger with Ms. Bakley and his motive to kill her," the prosecutors stated in a motion.

In the meantime, a large pool of potential jurors, including Blake's fellow thesps Christina Applegate and Harry Shearer, have filled out questionnaires regarding the details of the case.

Prospective jurors are due back in court February 17 for questioning from both sides to determine if they are fit to serve on Blake's trial.

Prosecutors also requested that the judge allow a "jury view" of locations related to the case, such as Vitello's, the Italian restaurant where the couple shared what would be Bakley's final meal. Also on the list of sites to see: the location where Blake's car was parked and a Dumpster that was in front of the car.

The attorneys want the jury to visit the sites as close to the time that the shooting actually occurred as possible--sometime between 9:23 p.m. and 9:40 p.m.

Blake was officially charged with Bakley's murder in April 2002, almost a year after her death.

In addition to the murder charge, the former Baretta star also stands accused of a special circumstance allegation of lying in wait, as well as an allegation that he personally used a deadly weapon.

Blake has maintained that he is innocent of the charges against him.

If convicted, Blake faces life in prison with no possibility of parole. He is currently free on $1.5 million bail.
