Big Mac's Legal Attack

The Macaulay Culkin clan is being flamed in court by an insurance company over a fatal fire in the family's apartment building.

Travelers Property Casualty has sued the Culkins for $113,000--the amount the insurers paid to five policyholders who suffered losses in the 1998 blaze that started in the actor's family's home and spread to other apartments in the Manhattan highrise.

Those named in the suit include Culkin's parents and the owners and managers of the building.

This lawsuit is pennies compared to the $80 million monster filed against Mac's mom, Patricia Brentrup, by those injured in the fire and surviving family members of those killed.

Fire investigators said the December 23, 1998, blaze was touched off by a faulty electric radiator that spewed sparks onto the couch and Christmas tree in a 19th-floor apartment belonging to the Culkins.

Brentrup, 42, was preparing breakfast when she heard the housekeeper's scream.

The maid and Brentrup rushed to rouse the Culkin kids--Dakota, 22; Quinn, 13; Chris, 10; and Rory, 8--out of the apartment, leaving the door propped open.

A blustery wind sent smoke and flames through adjacent floors of the 51-story building, killing four who tried to escape through a stairwell.

"People should close the door behind them when leaving a [burning] apartment," fire chief Dan Nigro told the New York Daily News.

Home Alone moppet Macaulay, 20, wasn't home. He moved out of the building after he married actress Rachel Miner. The former child star, now separated from Miner, is currently starring on stage in London in Madame Melville, which will soon come to Broadway.

Brentrup and several of her younger children still live in the apartments. Kit Culkin, the father of their seven children, is estranged from Brentrup, but lives in another apartment in the same building.

A spokesman for the Culkins had not seen the lawsuit and had no comment.
