Anna Nicole Still a California Girl
Anna Nicole Smith may have relocated to the Bahamas, but she still has to answer to the California legal system.
That's the word from Debra Opri, attorney to Larry Birkhead, an ex-boyfriend of Smith's who claims he is the father of her daughter, Dannielynn, and is suing her for paternity.
After a 75-minute closed hearing in the case Wednesday, Opri told reporters outside Los Angeles Superior Court that California courts have jurisdiction over Smith because she lived, worked and had a sexual relationship in the state up until recently.
Birkhead did not speak following the hearing, but gave reporters a thumbs-up.
Smith's attorney, Ron Rale, said Opri's statements were misleading, but declined to go into specifics.
"Her statements are inaccurate and reprehensible," he told reporters.
Even if California courts have jurisdiction over Smith, it remains unclear whether she can be forced to subject her infant daughter to DNA testing to either prove or disprove Birkhead's claim that he is the father.
Smith listed her attorney and partner Howard K. Stern as the baby's father on the birth certificate.
"Howard is the father of her," she told Entertainment Tonight in a recent interview. "I think it's crazy. I mean, it's all over the world that somebody is the father of my child."
Smith gave birth to Dannielynn in the Bahamas on Sept. 7, in the same hospital where, three days later, her 20-year-old son, Daniel, died of an accidental drug overdose.
Three weeks after that, she and Stern tied the knot in a nonbinding commitment ceremony.
To date, Birkhead has filed two lawsuits against the former Playboy Playmate. In the first, he alleged, among other things, Smith fled the United States to avoid being tested for drugs, claiming she had a methadone habit that was being supported by Stern.
He later filed a civil complaint charging Smith and Stern with fraud and conspiracy in a bid to have Stern's name bumped from the birth certificate and replaced with his own.
On Wednesday, Opri held up side-by-side photos of Birkhead and Dannielynn before reporters and cameras in an effort to show a resemblance between the two.
Rale told reporters the spectacle was "amusing to watch" and said he did not have any baby pictures of Stern handy for comparison purposes, the Associated Press reported.
Smith was released from Doctors Hospital in Nassau, Bahamas, Tuesday after spending a week there recuperating from pneumonia and a collapsed lung.
She has since returned to the waterfront mansion that she has been calling home, despite the efforts of a South Carolina developer to evict her from the premises.
