Anna Nicole Back on the Waterfront
If anyone needs a little R&R at this point, it's Anna Nicole Smith. And the people trying to keep up with her legal troubles, of course.
The 38-year-old reality star was released Tuesday from the Nassau, Bahamas hospital where she had been treated this past week for pneumonia and a collapsed lung.
Smith checked into Doctors Hospital—the same facility where she gave birth Sept. 7 to daughter Dannielynn and then lost her son, Daniel, three days later—on Oct. 30, complaining of pain in her side. The following day she underwent a procedure to drain fluid from her lung and stayed put as a precaution, considering her new-mom status put her at greater risk for complications.
"I think it takes quite some time to recover from a collapsed lung, and you have to keep up the breathing exercises for some time," Smith's attorney, Wayne Monroe, told the Associated Press. "But she's shown a high threshold for pain, having been through so much lately."
Smith said in a statement that "she would like to thank everyone at Doctors Hospital for their expert care."
Now Smith is back at the waterfront mansion she's been occupying since relocating to the Bahamas this summer—but whether she can declare herself back home, however, is another question.
While she was hospitalized, Smith's legal camp filed a lawsuit asking the island's high court to declare her the legal owner of the house, responding to a South Carolina developer's claim that Smith had failed to honor the mortgage payments after he loaned her money to buy the gated property.
G. Ben Thompson, who asserts that he and Smith dated for a short time last year, is looking to have her evicted, saying that he is "shocked and appalled by what she has done."
Also while the face of TrimSpa was ailing in a hospital bed, it was reported that toxicology tests had turned up seven drugs in Daniel Smith's system at the time of his death. However, the private pathologist who performed a second autopsy on the 20-year-old stood by his findings that it was only three drugs—methadone and the antidepressants Lexapro and Zoloft—that triggered Daniel's fatal heart attack.
In addition to the battle over her ocean-side manse, Smith is facing various legal actions brought by ex-boyfriend Larry Birkhead, who claims he is Dannielynn's father and is looking to get attorney Howard K. Stern's name removed from the little girl's birth certificate.
The paparazzo filed a paternity suit in Los Angeles demanding Smith bring Dannielynn back to the States for DNA and drug testing, alleging that Smith was addicted to methadone.
Last week, a (former?) friend of Smith, Laurie Payne, stated in a sworn deposition that Smith took Xanax and methadone during her pregnancy and that she had told Payne in an instant message that Birkhead was her baby's father, according to court documents obtained by TMZ.com.
Birkhead has since taken his case to the Bahamas, acquiring legal representation there and filing a civil action that accuses Smith and Stern of fraud and conspiracy.
Stern told Entertainment Tonight a couple of weeks ago that he and Smith kept their romance under wraps because they didn't want the public to get the wrong idea.

"This has been going on for years," Stern said. "Unfortunately, we have a lot of enemies who we thought were gonna try and hurt us in certain ways."
Smith informed ET that she was the one who initiated the relationship.
"I wanted more than a lawyer relationship, and then started kind of flirting with him and we kind of got it on," the former Playboy Playmate said. "I just kind of attacked him and that was it. I kissed him first. He was the shy one."
