Wes Craven Shores Up Lawsuit

Forget Freddy Krueger. Wes Craven's latest nightmare features a far scarier creature: Pauly Shore.

The horror-meister has gone to court to declare Shore a nuisance, claiming in a lawsuit against his Los Angeles neighbor that a series of shoddy Shore home improvements have left Craven's adjoining property substantially damaged.

In the complaint, filed in Los Angeles Superior Court Wednesday, Craven accuses the erstwhile Weeze of nuisance, negligence and negligent trespass and seeks unspecified damages after water runoff from Shore's home allegedly seeped onto Craven's property. [View the court documents here.]

The 67-year-old director of Scream and Nightmare on Elm Street fame claims that the 39-year-old Encino Man star began some upgrades on his home last year, but failed to take the necessary neighborly precautions, resulting in a water-triggered landslide eroding a portion of Craven's adjoining property on Dec. 19 or 20 of last year.

There was no immediate comment from Shore, but according to the lawsuit, he disputes the claims.

Per the suit, Shore "failed to properly or adequately design, construct, build, furnish, maintain and/or repair his yard," causing "substantial damage" to the Craven homestead, including a significant reduction in the value of the property, the exact amount of which will be determined in court.

Furthermore, Craven claims that Shore "knew or reasonably should have known" that his ill-fated renovations threatened his neighbor's property and thus was "under a duty...to avoid reasonably foreseeable injury to the owners and occupants."

Craven alleges that Shore's failure to prevent a surge of water, which, in addition to causing a "permanent and continuous nuisance," showed, per the suit, a negligent and careless disregard for the neighbors' boundary line, did damage to more than just his landscaping.

The director says the conditions caused by the slope failure are "injurious to the health" of him and his family and "cause an obstruction" to Craven's otherwise "peaceful use and enjoyment of his home and property."

As a result, Craven, who knows from horror, "has suffered and will continue to suffer severe emotional distress and anxiety" for which all he asks is a little yet to be determined compensation.

The filmmaker is seeking a judicial declaration to recoup his alleged losses from Shore, who can likely count himself out of a part in Craven's next onscreen thriller.
