Nicole Richie Ready to Make a Deal?

It's time for Nicole Richie to decide: deal or no deal?

Prosecutors have offered Richie a plea bargain in her DUI case, a Los Angeles Superior Court spokesman said. Terms of the deal were not disclosed.

The celebutante's attorney was due in court Wednesday morning to either accept or reject the offer on her client's behalf. 

Richie's attorney filed a motion Tuesday requesting a delay in the start date of the Simple Life star's DUI trial because an expert witness central to her defense was not available to testify on Wednesday as scheduled. (Read the motion.)

According to the court documents filed by attorney Shawn Chapman Holley, Dr. Terence Sean McGee, the drug expert retained to testify on Richie's behalf, will be unavailable for court because he will be out of the country until Aug. 5.

McGee is expected to challenge the conclusions reached by the prosecution's drug recognition expert following Richie's arrest.  

"His testimony will be critical to Miss Richie's case and there is no other expert retained by the defense who can testify in this regard," Holley wrote in the filing. 

As a result, the legal eagle asked that the start date of the trial be pushed back until Aug. 13.

Los Angeles Superior Court Commissioner Steven Lubell did not immediately grant the delay, but scheduled a hearing for Wednesday morning to hear arguments as to why the trial should be postponed once again. 

Of course, should Richie accept the plea deal, the continuance would become a moot point. 

Regardless of the outcome of the hearing, the trial will be delayed by at least one day, according to Jane Robison, a spokeswoman for the Los Angeles County District Attorney's Office.

Richie is not required to attend Wednesday's hearing and was photographed Monday catching a flight to Canada, where she reportedly plans to watch boyfriend Joel Madden's band Good Charlotte perform in Calgary Tuesday night. (Richie was clutching an oversized pillow to her midriff, either in a ploy to hide her supposed baby bump or just to screw with paparazzi; she has yet to confirm widespread rumors of her pregnancy.)

The 25-year-old starlet was arrested in December after allegedly driving the wrong way on a Los Angeles freeway. Police said she confessed to smoking marijuana and taking Vicodin before getting behind the wheel.

She pleaded not guilty at her arraignment hearing in February.

Because she has a previous DUI conviction on her record, she faces a minimum sentence of five days in jail under California law if convicted, and could be sentenced to up to a year behind bars.

Last month, Richie told E! News' Ryan Secreast that she was "nervous" about the possibility of going to jail, but but that she was prepared to "take responsibility" and "deal with whatever consequences" come her way.

"I just have to show up and fight my case," she said at the time.

Apparently, she plans to put off the showing up part for as long as she can.
