DMX Loses Dog Suit

DMX was barking up the wrong tree when it came to this business venture.

A Manhattan State Supreme Court judge has ordered the Year of the Dog emcee to fork over a $242,000 judgment to a fashion company for failing to fulfill a deal to hype a canine clothing line.

DMX, whose real name is Earl Simmons, had entered into a contractual agreement with Ellenville, New York-based Amusing Diversions to create Boomer 129, a label named after his dog and featuring such pooch-friendly apparel as caps, scarves, raincoats, sweatshirts and bomber jackets.

But the firm filed suit against the hip-hopster after he failed to sufficiently promoting the doggie duds in concert and during other public appearances. Amusing Diversions also accused DMX of marketing rival lines, causing substantial damage to the plaintiff.

"DMX, it appears, is known for his growl and bark and is called Pit Bull [which according to the evidence adduced at hearing, he has tattooed on his back]," Justice Jane Goodman wrote in her opinion issued July 25.

The rapper's best friend in such cases usually isn't the four-legged kind but rather Bronx-based criminal attorney, Murray Richman, who's gotten him out of numerous legal scrapes over the years.

But Richman said that he was unaware of the lawsuit and that either DMX had another lawyer working it or perhaps none at all.

Goodman noted in her ruling that DMX didn't mount much of a defense and ignored several hearings.

The civil judgment isn't the only problem the X man's ignoring.

The rapper-actor is still dogged by a pair of bench warrants issued in April by a city court in White Plains, New York. The judge is seeking DMX's arrest for skipping a pretrial hearing for two separate driving offenses.

As of press time, the warrants are still active.

DMX is famed for such albums as 1997's It's Dark and Hell is Hot, 1998's Flesh of My Flesh, Blood of My Blood, 1999's And Then There Was X, 2003's The Grand Champ and 2006's Year of the Dog...Again.  His latest release was the greatest hits compilation The Definition of X: The Pick of the Litter, which hit stores in June.

He is said to have begun working on his seventh studio effort, but there's no word yet on a street date.
