98 Degrees in the Hot Seat

Making the band isn't all it's cracked up to be.

After setting the charts on fire and selling millions of records, 98 Degrees has put the freeze on the former managers who got them there, according to a $25 million lawsuit brought by their estranged handlers.

In a complaint filed Wednesday in U.S. District Court in New York, Top 40 Entertainment and its chief executive, Paris D'Jon, claim the mega-selling boy band cut them out of earnings they were owed after helping turn the quartet into a hot multiplatinum-selling act.

A talent scout with an eagle eye, D'Jon "plucked from obscurity" the four future teen idols in October 1995--unknowns in the music biz at the time--and transformed them into pop superstars.

The suit claims that once the four singers signed on for representation with D'Jon and Top 40 Entertainment, the company financed the group, organized studio recording sessions and built the band into a household name by arranging promotional tours and TV appearances.

In December 1999, D'Jon and company didn't just get a cold shoulder from 98 Degrees. They got fired. The boy band terminated their contract despite company claims that the group still had another year left on its contract, which ran through October 2001.

Band lawyer John J. Rosenberg says 98 Degrees' decision to end its relationship with D'Jon and Top 40 was fair.

"The band's view is that they had more than ample grounds to terminate Mr. D'Jon and Top 40 as their manager," Rosenberg tells the Associated Press.

Rosenberg adds that the band, who trails a close third in terms of popularity behind rivals The Backstreet Boys and 'N Sync, is also considering a countersuit. Meanwhile, 98 Degrees new album, Revelation, debuted last week on the Billboard charts at number two, behind Mystikal.
