Tameka Foster's Custody Request Dismissed, Usher Keeps Sons Following Usher Raymond V's Near Drowning

An Atlanta judge has dismissed Tameka Foster's request for temporary custody of her and ex-husband Usher's sons following the near drowning of their 5-year-old Usher Raymond V.

Usher and Tameka met in court today where they each gave testimonies before the judge ruled in Usher's favor. During her time on the stand, Tameka claimed that Usher did not visit his son during his hospitalization and even became so emotional that she was brought to tears while recounting her son's underwater accident.

The dismissal means that Usher will continue to have primary custody of both Usher Raymond V and their 3-year-old son Naviyd. The 34-year-old performer was awarded primary custody of their two sons last year after a lengthy legal battle.

Tameka filed for an emergency custody hearing earlier this week after Usher Raymond V's pool accident, in which he got stuck underwater while trying to retrieve a pool toy in one of the drains. Contractors working at Usher's house rescued the boy and performed CPR on him before he was transferred to the hospital for care.

In the court filing, Foster's attorney, Angela Kinley, claimed "the children are at risk while in the care of third-party caregivers...while (Usher) travels around the world for his work-related activities."

After the judge dismissed Tameka's custody request, Usher and Tameka hugged for a lengthy embrace before leaving the courtroom.
