Kill Bill baddie catches a break after prosecutors don't have enough evidence to charge him for roughing up his kid

Michael Madsen played a mean mofo in Reservoir Dogs, but in real life, he's apparently not nearly as bad a dad as the law would have you believe.

A spokeswoman for the L.A. County District Attorney's Office confirms to E! News the 53-year-old actor will not face charges of child cruelty stemming from his bust last Friday in Malibu after he got into a row with his teenage son that allegedly led to fisticuffs.

Prosecutors cited insufficient evidence as the reason behind their decision.

The fight started, according to TMZ, when Madsen reportedly came home to find the teen smoking pot in the house. After cops received a call about a domestic violence incident, the Kill Bill actor was booked at the nearby Lost Hills Sheriff's Station and released on $100,000 bail.

Madsen later chalked up the whole thing to a "big misunderstanding."

Yeah, kind of like last year's legal hitch when he failed to turn up in court for a child and spousal support hearing, was found in contempt and had a warrant issued for his arrest.

Let's hope for the family's sake they've worked it out.
