Jesse James' Ex Can't See Their Kid Just Yet

Janine Lindemulder wants to get custody issues squared away before James moves to Texas with their daughter Sunny

Not so fast, Janine Lindemulder.

Jesse James' porn star ex-wife came out (of a halfway house) swinging Friday but lost a bid for immediate visitation rights with their 6-year-old daughter, Sunny.

A hearing to discuss a modification of their current custody arrangement is scheduled for June 17, but E! News has learned that Lindemulder is itching to get things squared away before James and Sunny move to Austin, Texas, at the end of the month.

A source says that Lindemulder is planning to move back to California in a few weeks after serving a four-month stint in an Oregon halfway house for parole violation and is hoping to regain joint custody of her daughter.

Since being locked up, Lindemulder has only been allowed to make phone calls to Sunny, not see her in person. At a hearing in February, James claimed that his ex was erratic when it came to getting in touch, sometimes going a week without calling and then bombarding them with text messages in the course of a day.

And now James is selling the Orange County home he shared with future ex-wife Sandra Bullock and our source says he's planning to move to Austin—where Bullock also has a home—at the end of June.

"He knows Sandra wont be able to resist seeing Sunny," the source says. "They have developed a very strong bond."

Bullock, meanwhile, has also been residing in New Orleans with her adopted son Louis, who was going to be her and James' son until James put a damper on that plan.
