As far as New York is concerned, Tom Brady and Gisele Bündchen are free to fire away at paparazzi—as long as it doesn't happen in the Empire State.

A state judge has tossed out a lawsuit filed by a couple of shutterbugs who claim that they were shot at by security guards in the employ of the star quarterback and his supermodel honey while trying to infiltrate the power couple's 2009 wedding celebration in Costa Rica.

Photos of the lensmens' strafed SUV seemed to back up the claims—so what went wrong?

State Supreme Court Justice Judith Gische says that because Brady and Bündchen don't live in New York, she didn't have jurisdiction.

The $1 million lawsuit brought by photogs Yuri Cortes and Rolando Aviles and the Agence France-Presse wire service had already bounced from federal court to state court.

No immediate word if the plaintiffs plan to refile in Massachusetts, home base of Brady's Patriots, or in Los Angeles, where the twosome is building a $20 million megamansion.
