Charlie Sheen Moving Back in With the Kids While Brooke's Away

Actor had been living at a friend's house since returning to L.A. following his Christmas arrest

Charlie Sheen is moving back in with his two little men.

With his ailing wife, Brooke Mueller, headed out of town for some badly need R&R, the actor has returned to the home he was sharing with Brooke and their twin sons before his Christmas arrest for allegedly assaulting her.

"Brooke can't be there right now because the children have germs, so as soon as she gets healthier, she will move back into the home," Mueller's attorney, Yale Galanter, tells E! News.

Which, according to the terms of the restraining order in place, will mean bye-bye, Charlie once again.

Sheen was temporarily allowed to see his wife while she was hospitalized with pneumonia in both lungs and an infection she caught after undergoing emergency surgery to have her wisdom teeth removed.

But upon her release from the hospital yesterday, the Two and a Half Men star must go back to staying away from her.

"She was well on her way to recovery, but if she got a cold or something it could be a setback, so they didn't want to put her in an environment with a lot of germs," Galanter explains.

And you know how little boys can be—nothing but frogs, snails and puppy dog tails.

Sheen, who was staying at a close friend's house nearby, will have plenty of help from nannies and housekeepers while Brooke is away, Galanter says.

The couple are both expected at a court hearing in Aspen on Feb. 8, where a judge will review the order of protection. The local D.A. is also expected to announce by then whether he'll be pressing charges against Sheen.
