Oscar winner files for legal separation from wife of 13 years; duo had reconciled for one year after withdrawing divorce

Sean Penn has apparently milked his marriage for all it's worth.

Proving the second time was not the charm for the newly minted Oscar winner and his missus, the actor has filed for a legal separation from Robin Wright Penn.

According to court documents, Penn filed for "legal separation with minor children" last Friday. The duo has two children together, 18-year-old daughter Dylan and 15-year-old son Hopper Jack. (No explanation was given as to why the 18-year-old is listed as a minor, but she just had her birthday on April 13, suggesting the filing may have been in the works for a bit.)

Per the Marin County Superior Court filing, Penn requested a termination in the court's jurisdiction to award spousal support to Wright Penn. He is also seeking joint custody of the kids.

This is the second time in as many years the actor's actors, who met in 1990 and have been married since 1996, have broken up.

Back on Dec. 21, 2007, it was Wright Penn who took legal action to end their union, filing a divorce petition in Marin County Superior Court. At the time, she sought joint custody of the kids and blamed the union's demise on irreconcilable differences, which, it turned out, weren't so irreconcilable after all.

A few short months later, in April 2008, the duo had the divorce dismissed and were soon back to living in what appeared to be marital bliss.

The 43-year-old Wright Penn accompanied her 48-year-old hubby at February's Oscars ceremony, playing the doting wife when he took home his second Best Actor trophy, for Milk.

Unfortunately, the split falls in line with another Hollywood tradition, namely the curse of winning an Oscar, losing your partner. Penn, who neglected to give his wife a name check during his acceptance speech, follows in the footsteps of Reese Witherspoon, Halle Berry, Hilary Swank and a pre-Danny Moder Julia Roberts.
