Avatar star Sam Worthington has entered into a conditional dismissal deal in his paparazzo assault case, according to the New York Daily News.

The 37-year-old Aussie actor did not appear in a Manhattan Criminal Court on April 8, but his attorney Stacey Richman accepted the non-jail deal on Worthington's behalf.

His case had been moved forward from its original date of May 8, and press was not inside the proceeding.

Through his attorney, the actor submitted a waiver to the judge explained that he was "contractually committed in Europe at this time," and thanked the court for working with his schedule.

"I understand that as long as I continue to lead a law abiding life, this matter will be dismissed and sealed," the outlet reports that Worthington wrote in a signed statement that had been notarized in L.A. County on March 31.

Under the terms of this particular deal, there are no additional requirements for Worthington.

Worthington was formally charged with two counts of assault in the third degree as well as one count of harassment after he allegedly punched photographer, Sheng Li, in New York City. Worthington claimed that the man kicked his girlfriend, Lara Bingle, in the shin at the time.

Had he been found guilty, he could have faced a maximum of one year in jail.

He was then given a restraining order against Li and ordered not to contact him in person, on the phone, or through any social networks.

Li was offered the same deal but declined it when he last appeared in court, saying that he would fight the charges.
