Jared Fogle's Wife to File for Divorce as Former Subway Spokesman to Plead Guilty to Child Pornography Charges

Jared Fogle's wife is filing for divorce.

Amid the news that the former Subway spokesman is expected to enter a plea deal today with regards to the recent child pornography charges, Katie Fogle tells E! News that she is in the process of splitting from Jared. 

"Obviously, I am extremely shocked and disappointed by the recent developments involving Jared. I am in the process of seeking a dissolution of the marriage," Fogle says in a statement. "My focus is exclusively on the well-being of my children. Neither I nor my family will have any further comment on the matter. I appreciate respect for my family's privacy during this difficult time." 

Fogle and his estranged spouse were married for five years and have two children together Brady, 4, and Quinn, 2. Per court docs obtained by E! News, Katie filed for divorce on August 19 and lists the date of separation as the date of the filing. She is asking the court for a dissolution of the marriage, a custody order for the children, child support, a just and reasonable division of the marital estate and other proper relief.

With regards to the child pornography charges, a plea agreement has been reached, according to court documents filed Wednesday by the U.S. District Court for the Southern District of Indiana and obtained by E! News, and Fogle will plead guilty to two federal counts including "distributing and receiving visual depictions of minors engaging in sexually explicit conduct and conspiring with others to do so" as well as traveling across state lines to "engage in unlawful commercial sexual acts with minors." 

Per court docs, the two charges may be punished by up to 50 years in prison. The documents also state that the parties have not agreed upon a specific sentence; the government has agreed to not as for more than 151 months while Fogle will not ask for a sentence below 60 months in prison. 

United States Attorney Josh J. Minkler released a statement today following the formal filing of the charges. "Mr. Fogle has admitted in court pleadings that he received child pornography involving multiple minors living in Indiana and other countries over the course of several years," said Minkler. "His child pornography crime began when he learned that alleged co-conspirator Russell Taylor was sexually exploiting a 14 year old girl in March 2011. At that time, Mr. Fogle did nothing to stop the abuse or report it to authorities, but chose instead to receive and repeatedly view the child pornography involving the girl and those other minors produced by his alleged co-conspirator in the years that followed. It total, Mr. Fogle admitted in court pleadings filed today that his actions caused the sexual victimization of a total of 12 minors in Indiana before his co-conspirator's arrest in April 2015.  He preyed on minor victims who did not have the ability to protect themselves."

Federal agents raided Fogle's Indiana home in early July following the April arrest of Russell Taylor, a former executive director of the Jared Foundation, on charges related to child pornography.

Yesterday, Subway wrote on Twitter "We no longer have a relationship with Jared and we have no further comment." 

Business Insider was the first to report last month that the FBI had subpoenaed an affidavit describing alleged texts been Fogle and a former female Subway franchisee, in which he reportedly says he paid for sex with a 16-year-old.

The age of consent in Indiana, where Jared resides, is 16.

Subway cut ties with Fogle back in April, after Taylor's arrest, and said in an earlier statement that they "mutually agreed to suspend their relationship due to the current investigation. Jared continues to cooperate with authorities and he expects no actions to be forthcoming. Both Jared and Subway agree that this was the appropriate step to take."
